RENT AGREEMENT

This Rent Agreement is executed at {{city}}, Tamil Nadu, on this {{today}}, by and between:

First Party / Owner

(Hereinafter referred to as the "First Party" or "Owner".)

Second Party / Tenant

(Hereinafter referred to as the "Second Party" or "Tenant".)

The expressions “First Party” and “Second Party” shall mean and include their respective legal heirs, executors, administrators, successors and permitted assigns.

Whereas

WHEREAS the First Party is the absolute and lawful owner of the property situated at {{property_address}} (hereinafter referred to as the “Property”).
AND WHEREAS, at the request of the Second Party, the First Party has agreed to let out the Property to the Second Party, and the Second Party has agreed to take the said Property on rent, on the following terms and conditions:

Terms and Conditions

That the monthly rent of the said Property is fixed by and between the parties at a sum of ₹ {{monthly_rent}}/-, and the Second Party shall pay the said monthly rent in advance on or before the {{due_day}} day of each English calendar month to the First Party.
That the First Party has let out the said Property to the Second Party for a period of {{tenure_months}} months with effect from {{start_date}} and the Second Party has agreed to vacate the premises after the expiry of the said period i.e., on {{end_date}}, unless extended by mutual consent.
That the Second Party shall pay the water charges and electricity charges for the said Property as per actual consumption, either to the First Party or directly to the concerned authorities, in addition to the aforesaid monthly rent.
That the house tax/property tax in respect of the said Property shall be borne and paid by the First Party alone.
That the Second Party shall pay monthly maintenance charges of ₹ {{maintenance}}/- to the First Party or directly to the concerned authorities, over and above the aforesaid monthly rent.
That the First Party has already received a sum of ₹ {{security_deposit}}/- through transfer as a security deposit from the Second Party. The said security deposit shall be refundable to the Second Party, without interest, at the time of handing over vacant and peaceful possession of the Property, after adjusting any damage to the Property beyond normal wear and tear.
Where applicable, the parties should verify whether any local law imposes a cap on the security deposit amount.
That if the Second Party desires to vacate the said premises before the expiry of the agreed tenancy period, then the Second Party shall serve a written notice of at least one month to the First Party.
That the tenancy period may be extended further with the mutual consent of both the parties, subject to an increase in rent at the rate of {{rent_increase}}% or such other rate as may be mutually agreed in writing.
That the Second Party shall not sublet, assign or part with possession of the said premises or any part thereof to any person in any manner during the tenancy period.
That if the monthly rent is not paid for a period of one month from the due date, the tenancy shall be liable to be treated as cancelled/terminated and the First Party shall be entitled to take appropriate steps for eviction of the Second Party as per law.
That the Second Party shall abide by all rules, regulations and directions of the concerned local bodies, statutory and other authorities in respect of the use and occupation of the said Property within the State of Tamil Nadu.
That the Second Party shall use the said premises for {{purpose}} purpose only and for no other purpose.
That the Second Party shall not make any structural additions, alterations or changes in the existing structure of the rented premises without the prior written consent of the First Party.
That all minor repairs and day-to-day maintenance of the said premises shall be carried out by the Second Party, whereas major structural repairs shall be carried out by the First Party/Owner.
That the Second Party shall not use the premises for any unlawful, illegal, immoral or objectionable activities and shall not store any hazardous, inflammable or explosive substances in the premises.
That the Second Party shall permit the First Party or its authorized agent to enter the premises at reasonable times, with prior notice, for inspection, maintenance or any other lawful purpose.
That the Second Party shall not use the address of the said premises for applying for or obtaining any loan, credit card or for any financial transaction of similar nature without the prior written consent of the First Party.
That the landlord and tenant agree that, where required, this tenancy may need to be recorded, registered, or filed before the competent authority, and both parties shall cooperate in completing any required formalities.
That in the event of breach of any of the terms and conditions of this Agreement by the Second Party, the First Party shall have the right to terminate the tenancy and take possession of the said premises from the Second Party in accordance with law, and all disputes arising out of or in connection with this Rent Agreement shall be subject to the exclusive jurisdiction of the courts at {{city}}, Tamil Nadu.
